The Committee on Veterans Affairs and Homeland Security moved to amend the bill on page one, after the enacting clause, by striking out the remainder of the bill and inserting in lieu thereof the following:

 

ARTICLE 10. INFORMATION SHARING BETWEEN LAW-ENFORCEMENT AGENCIES.

§15-10-7. Information Sharing with State Military Authorities.

 The head of any law-enforcement agency, or the head of any campus police, as those terms are defined in section three of this article, will provide information sharing related to all crimes involving uniformed or civilian members of the national guard of this State or of another State to the West Virginia Fusion Center for the primary purpose of assisting the National Guard in investigatory matters related to National Guard personnel regardless of incidental benefits to civil authorities.  Continued information sharing during the entire judicial process will be coordinated and conducted with the office of the Adjutant General Actions under this provision may include:

     (a) Investigations and other actions related to enforcement of the Uniform State Code of Military Justice, West Virginia Code, Chapter 15, Section 1E or the state code of military justice of the National Guard of another State or territory. 

     (b) Investigations and other actions involving uniformed or civilian members of the National Guard, regardless of whether a related civil or criminal proceeding is initiated.

     (c) Investigations and other actions related to reports of sexual assault or sexual harassment involving uniformed or civilian members of the National Guard, to include any cases of reprisal or retaliation. 

     (d)  Investigations and other actions related to a commander’s inherent authority to maintain law and order on a National Guard installation or facility.

     (e) Protection of classified defense information or equipment or controlled unclassified information.

     (f) Protection of National Guard personnel, equipment, and official guests.

     (g) Arrest of uniformed or civilian members of the National Guard.

 

NOTE: The purpose of this bill is to enhance information sharing between civilian law enforcement and state military authorities.
